Terms of Service

1. Agreement

By creating an account, purchasing a subscription, using the OTO device, or otherwise using our services (the “Services”), you agree to these Terms and our Privacy Policy. If you don’t agree, don’t use the Services. The Services are provided by Monday Fertility (“we,” “us”).

2. Eligibility

You must be at least 18 (or the age of majority where you live), and able to enter a binding contract. You agree to provide accurate account information.

3. What the Services Are — and Aren’t

The Services combine the OTO biosensor wearable, our app, and remote coaching from our Care Team to support your fertility journey.

Please read carefully:

• The Services support but do not replace independent medical advice, diagnosis, or treatment from your own physician or fertility specialist.
• We make no guarantee of conception, pregnancy, or any other outcome.
• The Services are not for emergencies. In an emergency, call 9-1-1 or go to the nearest emergency department.
• The OTO device is not a contraceptive and must not be used to prevent pregnancy.
• Readings and insights are informative; don’t make significant health decisions based on them alone.

4. Your Account and the OTO Device

You’re responsible for keeping your login secure and for activity under your account. Use the OTO device only as instructed; misuse or modification may damage it or produce inaccurate results. 

5. Subscriptions and Billing

Subscription pricing and billing frequency are shown at checkout, plus applicable taxes. Subscriptions renew automatically until cancelled, and you authorize us to charge your payment method each period. You can cancel anytime; cancellation takes effect at the end of the current period. We may change prices with at least 30 days’ notice before your next renewal.

6. Disclaimers and Liability

The Services are provided “as is” without warranties except as required by law. To the maximum extent permitted by law, we are not liable for indirect or consequential damages, and our total liability will not exceed the amount you paid us in the past 12 months. 

7. Privacy

By using the Services, you consent to receive care and communications electronically.

8. Termination

We may suspend or end your access if you breach these Terms or if we discontinue the Services. You may end them by cancelling and stopping use. Sections 3, 6, and 9 survive termination.

9. Governing Law and Changes

These Terms are governed by the laws of Ontario and Canada, and disputes are subject to the courts of Ontario. We may update these Terms and will give notice of material changes; continued use means acceptance.
